New legislation that came into effect on 15 January this year has quietly changed the game for Kiwi homeowners. You can now build a self-contained granny flat of up to 70 square metres on your property without needing a building consent or a resource consent.

In this guide, we’ll walk you through everything you need to know – from the rules and what they mean, to why 70sqm is actually a brilliant size, and what a well-designed floor plan looks like.

What are the new 70sqm granny flat rules in NZ?

With the change in the Building and Construction (Small Stand-alone Dwellings) Amendment Bill, it’s now easier, quicker and less costly to build a small standalone granny flat in Auckland or anywhere in New Zealand without a consent.

Here’s what the rules require:

The design must be ‘simple’, a stand alone, single storey, 70sqm or less, using lightweight materials for the roof and frame, as well as straightforward plumbing and drainage systems. The dwelling must comply with every aspect of the Building Code, must be at least 2m from all boundaries and residential buildings and not exceed 4m and all building work must be carried out or supervised by licensed building professionals.

Before starting, you must apply for a Project Information Memorandum (PIM) to notify your council. This helps the council assess whether the proposed dwelling meets the exemption conditions and flag any natural hazards or bylaws. On completion, which must be within 2 years – you must submit final ‘Record of Works’, certificates, and plans, and notify the council. So they can keep records of the Contractors who completed the works ie Builders, Architects, Electricians etc.

One thing to be aware of:

While the 2026 changes remove the need for building and resource consents, they do not remove other council charges. Councils may still charge Development Contributions for an additional dwelling, to account for increased demand on local infrastructure.

Why 70sqm is the perfect size

A well designed 70sqm granny flat can offer far more than its footprint suggests, it’s a remarkably liveable amount of space. It’s enough room to include a decent kitchen, bathroom, living area, and one or two bedrooms. Without the build cost, maintenance, and complexity of a larger home.

With careful planning, natural light, clever storage and good indoor-outdoor flow to a deck or garden can make the 70sqm granny flat feel surprisingly spacious and welcoming.

A space for aging parents to live, a hangout space for kids, growing teenager, or adult children saving for their first home or guest accommodation for friends/family. It also makes a great home office away from the busy house somewhere you can leave your things just as you left them.
